General terms and conditions of service

The present document defines the general terms and conditions governing the provision of services offered by Voyager en Albanie, a trademark owned by the company Luzo ALB L.L.C. registered in the Republic of Albania under identification number M41611030U on 11/04/2024 (hereinafter referred to as "the Service Provider") to suppliers of vehicles, apartments, hotels, tourist activities, and other tourism-related services (hereinafter referred to as "the Suppliers"). These conditions apply to any use of the services offered by the Service Provider.

  1. SERVICES

    1. The Service Provider acts as an intermediary between the Suppliers and the Clients. The services include providing an online platform allowing Suppliers to offer their services, promotion on social networks such as Facebook, Instagram, and TikTok, as well as managing reservations, payments, and communication between the parties involved. Unless otherwise specified, the initial contact with the Clients will be initiated by the Service Provider, who will then pass on relevant information to the Suppliers to ensure smooth and effective communication.

  2. SUPPLIER REGISTRATION

    1. To benefit from the services of the Service Provider, Suppliers must register on the platform by providing accurate and up-to-date information about their services. Only legally established Suppliers will have the right to offer their services. The Service Provider reserves the right to verify the information and legality of the Suppliers' activities and to refuse registration to those not meeting the required legal standards.

  3. RESPONSIBILITIES OF THE SERVICE PROVIDER

    1. The Service Provider undertakes to provide its services with diligence and professionalism. However, it cannot be held responsible for errors or omissions made by the Suppliers, nor for damages caused by them. The Service Provider strives to ensure the safety and reliability of the services offered on its platform, but it cannot guarantee the accuracy or completeness of the information provided by the Suppliers.

    2. In case of unavailability of a reserved good or service, Voyager en Albanie will endeavor to offer a satisfactory alternative to the client.

    3. Voyager en Albanie respects the laws and regulations in force in Albania concerning the provision of tourist services.

 

  1. RESPONSIBILITIES OF THE SUPPLIERS

    1. Suppliers undertake to respect ethical and legal standards in the provision of their services.

    2. Suppliers expressly prohibit charging unjustified additional fees upon service delivery. Any abusive opportunistic behavior towards Clients is also strictly prohibited. These practices include, but are not limited to, demanding excessive tips, undisclosed surcharges upon reservation via the Service Provider's platform for additional services, or any form of financial fraud.

    3. Suppliers are required to treat tourists with respect and courtesy at all times. This includes providing accurate and helpful information about the services offered, adhering to agreed-upon schedules, and professionally addressing Clients' questions or concerns. Any form of discrimination or disrespectful behavior towards tourists is strictly prohibited.

    4. Suppliers undertake to provide services that are accurate and in accordance with those offered on the platform. They must ensure that the services provided match the descriptions and conditions agreed upon with the Clients. Any deviation from client expectations must be communicated transparently and resolved satisfactorily, in agreement with the Service Provider.

    5. In case of dispute or claim, Suppliers agree to fully cooperate with the Service Provider to resolve the issue promptly and fairly. This includes providing all necessary information to assess the situation and implementing appropriate corrective measures to ensure Client satisfaction.

 

  1. CANCELLATION AND MODIFICATION

    1. Cancellation and modification policies vary by supplier and are indicated at the time of booking.

    2. Voyager en Albanie may charge cancellation or modification fees in accordance with the supplier's policies.

 

  1. PAYMENT TERMS

    1. Clients can make reservations and payments online through the Service Provider's platform. In some particular cases, Clients may make payment for their reservation in cash directly to the Suppliers.

    2. The Service Provider receives a commission on each transaction made through its platform. The terms of this commission vary depending on the type of service offered and are detailed in a separate agreement between the Service Provider and the Suppliers.

    3. The commission charged by the Service Provider may vary based on different criteria, such as the type of service provided (vehicle rental, accommodation booking, organization of tourist activities, etc.), transaction volume, or other factors agreed upon between the parties.

    4. Before being able to offer their services on the platform, Suppliers must accept the terms and conditions of the separate agreement established with the Service Provider. This agreement specifies details regarding the commission, payment terms, obligations of the parties, and any other specific conditions applicable to the collaboration between the Service Provider and the Suppliers.

    5. The Service Provider undertakes to ensure transparency of the fees and commissions charged on transactions made through its platform. Details of applicable fees will be clearly indicated to Suppliers in the separate agreement, as well as to Clients at the time of booking.

    6. Commission terms may be revised periodically based on evolving business needs, market conditions, or other relevant factors. Any changes to commission terms will be communicated to Suppliers with reasonable notice, and Suppliers will have the opportunity to accept or reject the new terms in accordance with the provisions of the separate agreement.

    7. Commissions due to the Service Provider will generally be deducted from the total transaction amount before funds are transferred to the Suppliers. Payment terms for commissions, including payment deadlines and settlement methods, will be specified in the separate agreement.

  2. MONTHLY SUBSCRIPTIONS “Support Package” 

    1. Monthly subscriptions offer a selection of packages to Suppliers according to their needs on a subscription model, including a free offer open to all, a "priority" offer, and a "premium" offer. These subscriptions commit the Service Provider to provide the services specified in each subscription. 

 

  1. The Service Provider cannot be held responsible for the effectiveness of the subscriptions due to external influences.

 

  1. These subscriptions are non-binding, and monthly payment is made by invoices. Subscriptions are not linked to sales and commercial activities. The service operates independently of commissions.

 

  1. In the absence of action from the Supplier, the subscription continues automatically on a monthly basis. To terminate the subscription, the Supplier must request it before the 15th of the previous month.



  1. CONFIDENTIALITY

    1. The Service Provider undertakes to treat the personal information of Clients and Suppliers with confidentiality and to use it only for the purpose of providing its services. The collected data will not be disclosed to third parties without prior consent, except as required by law or requested by competent authorities.

  2. MODIFICATION OF TERMS

    1. The Service Provider reserves the right to modify these general terms and conditions at any time, subject to prior notification to Suppliers. The modifications will take effect on the date of their publication on the Service Provider's platform, unless otherwise indicated. Continued use of the services after the publication of modifications constitutes acceptance of those modifications.

  3. APPLICABLE LAW AND JURISDICTION

    1. These general terms and conditions are subject to the applicable law in the country where the Service Provider is established, the Republic of Albania. Any dispute arising from the interpretation or execution of these conditions will be under the exclusive jurisdiction of the competent courts of the place where the Service Provider is established.

  4. ANNEXES

  • Service Provider: Voyager en Albanie, a trademark owned by the company established in Albania, Luzo ALB L.L.C. registered under identification number M41611030U, offering reservation services for vehicles, apartments, hotels, tourist activities, and other tourism-related services.

  • Supplier: Any natural or legal person offering goods or services available for reservation via the platform of Voyager en Albanie.

  • Client: Any natural or legal person using the reservation services of Voyager en Albanie to book goods or services from the suppliers.

  • Platform: The online interface provided by Voyager en Albanie (www.voyagerenalbanie.fr), accessible through its website, where Suppliers can add their services, manage reservations, upload documents, and interact with Clients. It serves as a central hub for facilitating the booking process and service provision between Suppliers and Clients

 

By accepting these general terms and conditions, Suppliers acknowledge having read, understood, and accepted the terms and conditions governing the provision of services offered by the Service Provider.
